The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Iran.

Description of the situation:

According to the information received, Mr. Kaboudvand was arrested on July 1, 2007 and has been detained at the prison of Evin in Tehran since then. No reason for the arrest was given. His home was subsequently searched and some of his personal belongings (documents, books, computer, CDs, movies, etc.) were confiscated by the agents of the prosecutor’s office of the Revolution.

Mr. Mohamad Sadigh Kaboudvand had already been condemned last year to a one-year suspended imprisonment sentence and to five years of privation of his journalistic activities for his involvement in the defence of human rights as well as for the publication of some articles defending cultural, social, and political rights of the Kurds in the Kurdish newspaper Payam-e Mardom-e Kurdistan (The Message of the People of Kurdistan). Mr. Kaboudvand is the redactor-in-chief of this newspaper and the founder of the RMMK.

The Observatory expresses its deep concern about this arrest which takes place in the context of an increasing harassment of human rights defenders, independent journalists and academics in the Iranian Kurdistan. The situation has indeed deteriorated since the pacific demonstrations organised by the Kurdish population of Iran in July and August 2005, which were violently repressed by the authorities.

The Observatory further recalls that Iran had committed to “uphold the highest standards in the promotion and protection of human rights”1 by presenting its candidacy to the Human Rights Council 2006 election and had insisted in this regard on the fact that the country had “continuously put great efforts into safeguarding the status and inherent dignity of the human person as well as the promotion and protection of human rights and fundamental freedoms”2. In order to ensure the continuation of these efforts, the Observatory urges the Islamic Republic of Iran to conform with international human rights standards.

Actions requested:

Please write to the authorities in Iran urging them to:

– i.Guarantee in all circumstances the physical and psychological integrity of Mr. Mohamad Sadigh Kaboudvand;
– ii.Release Mr. Mohamad Sadigh Kaboudvand immediately and unconditionally as his detention is arbitrary;
– iii.Put an end to any act of harassment, including judicial harassment, against Mr. Mohamad Sadigh Kaboudvand, as well as against all human rights defenders in Iran;
– iv.Conform with the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998, which provides that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” (Article 1), that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the [...] Declaration” (Article 12.2), and that “for the purpose of promoting and protecting human rights and fundamental freedoms, everyone has the right, individually or in association with others [...] to form, join and participate in non-governmental organisations, associations or groups” (Article 5b);
– v.More generally, ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international and regional human rights instruments ratified by Iran.
