The IACHR condemns Chile for violation of the rights of victims of the dictatorship

On September 2, 2015, the Inter-American Court of Human Rights condemned the State of Chile in the case of Omar Humberto Maldonado Vargas and others vs. Chile. The Court declared the State of Chile responsible for the impossibility for the former military legalists to have access to effective legal remedy for the judgments of the courts martial pronounced against them and based on confessions obtained under torture. Furthermore, the Court found the State of Chile responsible for delaying for 12 years the opening of an inquiry into the torture of some of the petitioners.

In 2003, FIDH and CODEPU, its Chilean organization had taken Chile before the IACHR. They defended together the admissibility of the case in 2007 and prepared the trial and participated in meetings with the State in 2008-2009. In 2009, FIDH had enabled a meeting for the victims in Washington DC, headquarters of the IACHR, where they able to conduct advocacy.

The decision of the Court is an important step in the fight against impunity in Chile, especially regarding the fate of military legalists and access to justice for victims of military justice under dictatorial regimes.
