Binding Treaty on Business and Human Rights: FIDH’s preliminary comments on the ’Third Revised Draft’

Today, FIDH publishes its preliminary comments including concrete suggestions to reinforce the text and ensure it addresses the accountability gaps, providing victims of corporate abuse better guarantees of justice.

Ahead of the 7th session of the United Nations open-ended intergovernmental working group on transnational corporations and other business enterprises with respect to human rights (IGWG) in charge of elaborating a Legally Binding Instrument (LBI) to regulate the activities of transnational corporations and other business enterprises to be held from 25 to 29 October 2021 in Geneva, the Chair published the Third Revised Draft of the LBI.

The text is stabilizing even if some issues related to access to justice for victims of corporate abuse remain pending and should be thoroughly addressed during this session.We urge State parties to participate in a committed manner throughout these negotiations and to come up with concrete textual proposals to consolidate the strength and overcome the remaining issues in the draft. This is a key opportunity for States to advance the process towards the fulfillment of the mandate of the IGWG.
