Comments on the second draft of the Spanish National Action Plan for the implementation of the UN Guiding Principles

On 20th December 2013, FIDH submitted written comments on second draft of the Spanish National Action Plan for the implementation of the UN Guiding Principles on Business and Human rights.

FIDH welcomed the second draft of the Spanish government’s National Action Plan to implement the UN Guiding Principles on Business and Human Rights and the creation of a Multi-stakeholder Monitoring Committee responsible for periodically evaluating the execution of the Action Plan and for making proposals for its effective implementation.
FIDH particularly welcomes the proposal to examine the Spanish regulatory and institutional framework in light of the Guiding Principles to ensure an effective protection of human rights in the context of business activities.

FIDH made various suggestions of amendments, including: incorporating in the legal system mandatory due diligence for companies, strengthening the reporting and transparency requirement for social and environmental issues, ensuring greater policy coherence as well as access to effective remedies for victims of violations of human rights involving Spanish companies, and in particular calling for a review of legal options to facilitate the exercise of extraterritorial jurisdiction in case of corporate-related human rights abuses and for the strengthening of the structure and functioning of the OECD’s National Contact Point.

The finalised Spanish National Action Plan is expected to be adopted by the end of February 2014.
