Mexico: Government receives joint communication from UN independent experts

The joint communication signed by the Special Rapporteur on violence against women and girls, its causes and consequences; the Special Rapporteur on trafficking in persons, especially women and children; the Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment; the Working Group on Enforced or Involuntary Disappearances; and the Working Group on discrimination against women and girls, published on 21 August 2024, calls the attention of the Government of Mexico about the information received that shows an ostensible situation of violence committed against women, girls and teenagers in the state of Guerrero.

The communication notes the “existence of a practice of forced disappearance of women and girls. Such practice would have been perpetrated in a significant number of cases by individuals, private individuals probably linked to the organized crime, and possibly with the support or complicity of state agents.”

In addition, the communicate notes the absence of a timely response by the authorities to search for and investigate reports of enforced disappearances of women and girls, as well as “the almost absolute impunity in which these acts remain”. The experts also highlight that this situation is framed “in a broader context of gender violence against women and girls in the state of Guerrero and in the alarming context of enforced disappearances and, in particular, the enforced disappearances of women and girls in Mexico for almost three decades”.

This call by independent experts of the United Nations to the government of Mexico comes after advocacy carried out by FIDH and IDHEAS Strategic Litigation in Human Rights (IDHEAS) in the framework of the 88° session of the Committee for the Elimination of Discrimination against Women in September 2023. On this occasion, the FIDH and IDHEAS held a meeting with Ms Reem Alsalem, United Nations Special Rapporteur on violence against women and girls, its causes and consequences, with whom information was shared regarding the problems of women and girls in the state of Guerrero, as well as the report entitled: “Disappearances of women and gender-based violence in Guerrero: The invisible side of the war on drugs”.

This report - authored by FIDH, IDHEAS and EMAF, with technical assistance from Justice Rapid Response (JJR) - was published in Geneva on 11 September 2023. It details human rights violations linked to the problem of enforced disappearances of women and girls in the state of Guerrero, as well as the serious situation of impunity, ineffectiveness in the search for disappeared women and girls, and structural deficiencies in access to justice, in the context of a profound patriarchal culture.

FIDH welcome this joint statement issued by the independent experts of United Nations and urges the government of Mexico to take effective actions to search for disappeared women and girls in Guerrero and other states, as well as to investigate the facts and ensure access to justice for all the victims and their families.
