ارفضوا الإفلات من العقاب: لا تنسحبوا من المحكمة الجنائية الدولية

إعلان من الفدرالية الدولية لحقوق الإنسان و أكثر من ١٠٠ من المنظمات الأعضاء والشريكة

تقوم منظماتنا بالدفاع عن حقوق الإنسان في أرجاء العالم، ومناصرة ضحايا أخطر الجرائم، أينما وقعت وأياً كان مرتكبوها. ونحن نستنكر كل الاستنكار الإجراءات التي اتخذتها حكومتا بوروندي وجنوب أفريقيا للانسحاب من المحكمة الجنائية الدولية، ونبدي القلق من أن تكون هذه الإعلانات المبدئية بمثابة تمهيد لانسحابات تالية.

إننا نؤمن كل الإيمان بأن على المحكمة الجنائية الدولية أن تتطلع إلى العالمية، حيث لا يجوز لها التدخل إلا حينما تفتقر أنظمة العدالة الوطنية المختصة إلى الإرادة أو القدرة على تقديم العدالة للضحايا. وكما توضح تصديقات 124 دولة، والالتزام المستمر من قبل المجتمع المدني، فإن المحكمة الجنائية الدولية تؤدي دوراً محورياً في التماس العدالة الدولية.

والتحقيق الجاري في الجرائم المرتكبة في جورجيا، إلى جوار ما تحقق من تقدم في التحقيقات المبدئية المفتتحة في أفغانستان وفلسطين وأوكرانيا والعراق، ضمن دول أخرى، تعكس كلها الاتجاه الذي قد يتخذه مكتب الادعاء التابع للمحكمة في تحقيقاته المقبلة. إن سياسة مكتب الادعاء تبرهن على أن المحكمة لن تتراجع عن ممارسة ولايتها على الجرائم الدولية الداخلة في اختصاصها، حتى إذا كان مرتكبو تلك الجرائم هم أشخاص تابعون لقوى العالم الكبرى، مثل الولايات المتحدة أو إسرائيل أو روسيا أو المملكة المتحدة. وسوف نظل نناصر مكتب الادعاء أو المحكمة الجنائية الدولية ككل في إجراء تلك التحقيقات.

ويجب أن نتذكر أن المحكمة الجنائية الدولية، إذا كانت قد افتتحت تحقيقات في شؤون بلدان أفريقية في سنوات إنشائها الأولى، فقد كان هذا جزئياً لأن الدول الأفريقية نفسها أيدت إنشاء المحكمة تأييدا ساحقاً منذ 1998، بالتصديق على نظام روما الأساسي، وكذك باتخاذ دور قيادي في تعزيز التحرك نحو المحاسبة. وقد قامت عدة دول أفريقية بإحالة قضاياها إلى المحكمة الجنائية الدولية للتحقيق في أخطر الجرائم المرتكبة على ترابها.

إننا نؤمن بأن الانسحاب من المحكمة الجنائية الدولية يكافئ الإفلات من العقاب، كما يشكل الانسحاب تهديداً لواحد من أهم مكتسبات العدالة في القرن الحادي والعشرين، وهذا في وقت ترتكب فيه جرائم الإبادة الجماعية والجرائم ضد الإنسانية وجرائم الحرب بانتظام وفي جميع أنحاء العالم.

وإياكم وأن تختلط عليكم الأمور، فالجبابرة قساة القلوب وحدهم يخشون المحكمة الجنائية الدولية، لا الضحايا الذين يضعون أملهم في المحكمة حينما لا يثمر سعيهم إلى العدالة عن شيء على الصعيد الوطني. يصدق هذا على أفريقيا بقدر ما يصدق على سائر القارات: لا يجوز حماية مخلوق من العدالة.

إننا ندعو الدول الأطراف إلى عدم الانسحاب من المحكمة الجنائية الدولية، وندعو الدول التي لم تصدق على نظام روما الأساسي إلى التصديق في أقرب موعد ممكن، فالعدالة الجنائية الدولية ركن ضروري لتحويل عالمنا إلى مكان أكثر إنصافاً وأمناً. والقضية لا تقتصر على المحاسبة أو احترام حقوق الإنسان، بل هي قضية الحفاظ على مستقبلنا المشترك.
